MAXXIS PCR & SUV TYRES Program – Terms and Conditions
MAXXIS TYRES SOLD IN AUSTRALIA (AS PROVIDED IN THESE TERMS) WILL BE COVERED UNDER THE MAXCOVERAGE PCR & SUV TYRES PROGRAM GIVING YOU PEACE OF MIND.
By choosing MAXXIS Tyres you have made a great decision. What you would not want in life is for your new tyres to be destroyed by unexpected road hazards such as nails, debris and potholes.
Therefore, at a cost of $10.00 (incl. GST) per tyre, MAXXIS offers you benefits under the MAXCOVERAGE PCR & SUV TYRES Program (as detailed in these terms).
The MAXCOVERAGE PCR & SUV TYRES Program consists of the following benefits:
- 30 Day Satisfaction Guarantee
- 2 Year Road Hazard Warranty
- 2 Year Tyre Roadside Assistance
A. Terms of the MAXCOVERAGE PCR & SUV TYRES Program – Defined Terms
‘Authorised MAXXIS Dealer‘ means a tyre dealer authorised to sell and fit MAXXIS Tyres within Australia, and detailed at https://maxxistyres.com.au/store-locator/.
‘MAXCOVERAGE PCR & SUV TYRES Program Registration’ means the registration process detailed in these terms at item 3 under ‘B. Terms of the MAXCOVERAGE PCR & SUV TYRES Program – General’.
‘MAXXIS’ means Tyremax Pty Ltd ATF the On Track Tyres No 2 Trust (ABN 98 050 635 023) of 1 Heyington Avenue, Thomastown, Victoria’.
‘MAXXIS Tyre’ means any MAXXIS branded tyre suitable for, and legally fitted to, passenger cars, SUVs and light commercial vehicles (as defined by MAXXIS), other than any TBR (Truck and Bus Radial) tyre 17.5” or greater in diameter, that is the subject of a MAXCOVERAGE PCR & SUV TYRES Program Registration.
‘Registration Details’ means:
- your contact details, being your name, state/territory, contact phone and email details;
- your vehicle registration details, vehicle make, model & mileage (to which the MAXXIS Tyres had been fitted to by an Authorised MAXXIS Dealer); and
- the MAXXIS Tyres purchased, including pattern, size & tyre pressures (if applicable); and
- a copy of your Maxxis tyres purchase tax invoice (showing the date of purchase, place of purchase, tyre type (brand and pattern) and quantity.
‘Road Hazard Tyre Damage’ means accidental damage caused to a MAXXIS Tyre due to unseen road hazards such as punctures, accidental cuts, accidental curb damage, impact breaks (e.g. potholes) and other damage caused by unforeseen road hazards (but excluding an Unauthorised Event).
‘Tyre Tread’ means the depth of tyre tread remaining on a MAXXIS Tyre, the subject of a claim under the MAXCOVERAGE PCR & SUV TYRES Program, at the time of claim (based & measured on the manufacturer’s new tread depth specifications).
‘Unauthorised Event’ means damage caused to a MAXXIS Tyre due to:
- mechanical and/or wheel alignment issues;
- under-inflation, over-inflation, and/or improper maintenance;
- vandalism or other intentional damage;
- competition/racing and/or commercial/industrial use;
- using a MAXXIS Tyre on an unsealed road surface or in off-road conditions.
‘You’ or ‘you’ means the original purchaser of the MAXXIS Tyres from an Authorised MAXXIS Dealer.
B. Terms of the MAXCOVERAGE PCR & SUV TYRES Program – General
The MAXCOVERAGE PCR & SUV TYRES Program:
- only applies to MAXXIS Tyres purchased as a set of 4 or more tyres from an Authorised MAXXIS Dealer on or after 31st January 2022;
- is not transferrable i.e. only entitles you to its benefits;
- only applies if you have (a) paid a participation fee of $10.00 (incl. GST) for each MAXXIS Tyre detailed in the invoice regarding your MAXXIS Tyre purchase from an Authorised MAXXIS Dealer, and (b) registered your purchase of the MAXXIS Tyres online, providing all Registration Details as part of that registration process at https://maxxistyres.com.au/max-coverage, within 14 days of the invoice date regarding that purchase;
- does not apply to any MAXXIS Tyre removed from the original vehicle on which it was fitted by an Authorised MAXXIS Dealer at the time of purchase;
- does not apply to a MAXXIS Tyre damaged due to an Unauthorised Event;
- does not provide compensation for loss of time, loss of use of vehicle, inconvenience or consequential damage caused;
- does not apply or extend to a vehicle’s rims or other componentry;
- does not constitute a mileage warranty; and
- is provided in addition to your rights as a consumer under the Australian Consumer Law.
Being an optional warranty (i.e. a warranty in addition to your rights under the Australian Consumer law), the MAXCOVERAGE PCR & SUV TYRES Program shall only apply if each of the above matters are fully satisfied whether or not you were aware of, or made aware of, the terms and conditions of the MAXCOVERAGE PCR & SUV TYRES Program either prior to, at the time of, or subsequent to your purchase of a set of 4 or more MAXXIS Tyres from an Authorised MAXXIS Dealer.
C. Terms – 30 Day Replacement Guarantee
What is covered?
MAXXIS want to give you assurance you have made the right choice, but if for some reason you think otherwise, MAXXIS offers you, subject to the terms detailed below, a 100% Satisfaction Guarantee for 30 days from the invoice date regarding your purchase of any set of 4 or more MAXXIS Tyres from an Authorised MAXXIS Dealer.
What is not covered?
MAXXIS Tyres that are damaged for reasons unrelated to a fault of the MAXXIS Tyres, including damage suffered due to an Unauthorised Event.
Any MAXXIS Tyre having a Tyre Tread depth less than required to be legally roadworthy.
All removal costs associated with removal of MAXXIS Tyres from your vehicle, all fitting costs associated with fitting of replacement tyres to your vehicle, and the cost of replacement tyres (to the extent such costs exceeds the purchase price of the MAXXIS Tyres being returned).
Any replacement tyre fitted under this guarantee.
Claim process – qualifications & exclusions
- A claim must be made to the Authorised MAXXIS Dealer that you purchased the MAXXIS Tyres from or via the Maxxis Maxcoverage Helpline on 1300 644 851, and must be made within the period 15 to 30 days from the invoice date regarding that purchase.
- A claim must be made by completing a claim form (to be supplied by the Authorised MAXXIS Dealer or via the Maxxis Maxcoverage Helpline on 1300 644 851), together with (1) evidence of MAXCOVERAGE PCR & SUV TYRES Program Registration, and (2) the original customer invoice the subject of the MAXXIS Tyres purchase.
- A claim requires you to purchase replacement tyres (whether a MAXXIS Tyre or otherwise) from the Authorised MAXXIS Dealer that you purchased the MAXXIS Tyres at the time of claim.
- MAXXIS Tyres replaced in accordance with this guarantee become the property of MAXXIS.
D. Terms – 2 Year Road Hazard Warranty
What is covered?
For any MAXXIS Tyre purchased that is damaged beyond repair due to Road Hazard Tyre Damage, MAXXIS will replace the MAXXIS Tyre damaged (unless MAXXIS or its Authorised MAXXIS Dealer elect to repair the MAXXIS Tyre damaged) with a new comparable MAXXIS Tyre within 2 years of the invoice date regarding the purchase of that damaged MAXXIS Tyre.
In the case of a replacement MAXXIS Tyre, whilst MAXXIS will supply that replacement MAXXIS Tyre at its own cost, you shall be responsible for all charges involved in the removal of the damaged MAXXIS Tyre and fitting of the replacement MAXXIS Tyre to your vehicle.
In the case where the damaged MAXXIS Tyre is repaired, the cost of that repair, including usual charges involved in the removal, repair and re-fitting of the damaged MAXXIS Tyre to your vehicle, will be covered under this warranty.
This warranty is capped at a maximum of 4 MAXXIS Tyre repairs and/or Maxxis Tyre replacements within the 2 year warranty period.
What is not covered?
MAXXIS Tyre damage caused by an Unauthorised Event.
Any damaged MAXXIS Tyre (a) that is repairable, having a Tyre Tread depth less than required to be legally roadworthy, or (b) that is damaged beyond repair, having a Tyre Tread depth of 50% or less.
Claim process – qualifications & exclusions
- A claim must be made to any Authorised MAXXIS Dealer or via the Maxxis Maxcoverage Helpline on 1300 644 851 within 2 years from the invoice date regarding the MAXXIS Tyres purchased.
- A claim must be made by completing a claim form (to be supplied by the Authorised MAXXIS Dealer or via the Maxxis Maxcoverage Helpline on 1300 644 851), together with (1) evidence of MAXCOVERAGE PCR & SUV TYRES Program Registration, and (2) the original customer invoice the subject of the MAXXIS Tyres purchase.
- MAXXIS or its Authorised MAXXIS Dealer may elect to repair a MAXXIS Tyre unless the tyre is deemed unserviceable (e.g. unable to be repaired by a repair patch or similar).
- MAXXIS or its Authorised Dealer has the right to inspect a MAXXIS Tyre, the subject of a claim under this warranty, to assess and verify eligibility for the claim.
- MAXXIS Tyres replaced in accordance with this warranty become the property of MAXXIS.
E. Terms – 2 Year Tyre Roadside Assistance
What is covered?
For any MAXXIS Tyre purchased, you will enjoy 2 year tyre roadside assistance (from the invoice date regarding the MAXXIS Tyres purchased) for any Road Hazard Tyre Damage you encounter with your MAXXIS Tyre. For the sake of completeness, this roadside assistance shall not apply to any non-tyre related issue.
Roadside assistance can be accessed by way of a dedicated phone line 24 hours a day, 365 days a year, anywhere in Australia.
What is not covered?
Damage caused to a MAXXIS Tyre due to an Unauthorised Event, or roadside assistance required due to an event other than Road Hazard Tyre Damage. Where towing is involved, it will only be free of charge up to 50 kilometres radius from the point of incident.
Claim process – qualifications & exclusions
- A request for roadside assistance may be made by you within 2 years from the invoice date regarding the MAXXIS Tyres purchased.
- A request for roadside assistance must be substantiated, if requested, by (1) evidence of MAXCOVERAGE PCR & SUV TYRES Program Registration, and (2) the original customer invoice the subject of the MAXXIS Tyres purchase.
- Roadside assistance provided to you as a result of either (1) damage caused to a MAXXIS Tyre due to an Unauthorised Event, or (2) an event other than Road Hazard Tyre Damage, will be at your own cost. To the extent that MAXXIS incurs a cost associated with roadside assistance provided as a result of such an event, you must reimburse to MAXXIS such cost immediately on demand.
- You must comply with all requirements of the roadside assistance provider, as advised from time to time.
- MAXXIS Tyres replaced as a consequence of roadside assistance provided become the property of MAXXIS.
