- By participating in this competition (‘Promotion’), participants (‘Participants’) are deemed to agree with these terms and conditions.
- Participants must be Australian residents aged 18 years or older.
- The promoter means the legal entity identified in the Maxxis Tyres Australia privacy policy found at https://maxxistyres.com.au/privacy/ (‘Promoter Privacy Policy’ and ‘Promoter’ respectively).
- Employees (and their immediate family members) of the Promoter and agencies associated with the Promotion are ineligible to participate in the Promotion.
- The Promotion commences at 9:00 am AEST on 14 June 2018 and closes at 5:00 pm AEST on 14 July 2018 (‘Promotion Period’).
- To enter, the Participant must, during the Promotion Period, provide a response limited to a maximum of 25 words, on the promotional Facebook post on the Maxxis Tyres Australia Facebook Page (www.facebook.com/MAXXISTyresAustralia), to the Promotion question: “Tell us how you’ve gone the ‘Exxtra Mile’ for a mate”.
- The Participant (a) agrees that all content submitted with their entry is their original work and will not infringe the rights of any third party, (b) consents to the use of such content by the Promoter, and (c) indemnifies the Promoter for any breach of these terms and conditions.
- Only one entry is permitted per Participant. Multiple entries will not be considered.
- The Promotion is a game of skill and chance plays no part in determining the winner. Each entry will be judged based on creative merit and literary merit of the response provided to the Promotion question.
- The Promoter reserves the right to (a) verify the validity of Participants and their entry, (b) reject any entry that is incomplete, indecipherable or illegible, and (c) disqualify any Participant submitting an entry which, in its opinion, includes objectionable content (including, but not limited to, profanity, nudity, insulting, inflammatory or defamatory images or language).
- The judging of all valid entries will take place on 16 July 2018 at the Promoter’s business address at 1 Heyington Avenue, Thomastown, Victoria. The best valid entry, as determined by the Promoter, will win the Promotion noting that the Promoter may select additional reserve entries which it determines to be the next best, and record them in order, in case of an invalid entry or ineligible Participant. In all cases, the Promoter’s decision is final and no correspondence will be entered into.
- All entries become and remain the property of the Promoter. The Promoter may use the Participant’s name and entry content for any commercial purpose, including future promotional marketing and publicity purposes.
- All personal information about a Participant submitted as part of an entry will be protected in accordance with the Promoter’s Privacy Policy. All Participants who choose to ‘opt in’ consent to have their contact details released to the Promoter and to receive ongoing marketing material and communications from the Promoter and agencies associated with the Promotion.
- The winner will be notified by email and will be also be posted on the MAXXIS Tyres Australia Facebook page after conclusion of the Promotion Period and by 17 July 2018. If for any reason a winner does not take or claim the prize by 17 August 2018, the Promoter may either (a) award the prize to another valid Participant, or (b) treat the prize as forfeited.
- There is one individual prize to be won. The prize is a set of MAXXIS HP5 Tyres (4 tyres) up to the value of $900 (inclusive of GST). This value is based on recommended retail price. The prize does not include rims/wheels but includes fitting & balancing at a mutually agreed Maxxis Tyres Australia dealer within Australia. The winner shall be responsible for transporting their vehicle (or rims/wheels) to the location at which the prize is to be fitted, and any costs associated.
- The prize is not transferable, non-refundable and not redeemable for cash.
- If for any reason the Promotion is interfered with or is not capable of being conducted as reasonably anticipated due to any reason beyond the control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Participant, or (b) modify, suspend, terminate or cancel the Promotion.
- The Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to direct or consequential loss) or for any personal injury suffered or sustained in connection with the prize, except for any liability which cannot be excluded by law.
- The winner should seek independent financial advice related to the prize.
